These terms of use (the "Terms of Use") govern your use of the MbuniGroup website (the "Website") and our "MbuniGroup" application for mobile and handheld devices (the "App"). The Website and the App are collectively referred to as the "Platform". Please read these Terms of Use carefully before using our services. By using the Platform, you agree to these Terms of Use and other policies (including but not limited to the Cancellation & Refund Policy, Privacy Policy, etc.) posted on the Platform, which become binding upon downloading, installing, or using the Platform.

Use of Platform and Services

All commercial/contractual terms are agreed upon between Buyers and Sellers (Merchants) alone. This includes, but is not limited to, price, taxes, shipping costs, payment methods, delivery dates, warranties, and after-sales services. MbuniGroup does not have any control over, nor does it advise or participate in the commercial terms agreed upon by Buyers and Merchants. MbuniGroup serves only as a facilitator and does not take possession of any goods or services offered by Merchants.

MbuniGroup is not responsible for any non-performance, breaches, or damages arising from contracts made between Buyers and Merchants on the Platform, including any goods being unavailable or back-ordered.

Responsibilities of MbuniGroup:

• Facilitating the connection between Buyers and Merchants.
• Offering support services related to order fulfillment, payment collection, and customer service.

Responsibilities of the Buyer:

• Reviewing product details, prices, and availability provided by the Merchant.
• Ensuring accurate delivery address information at the time of order placement.

Disclaimers:

• MbuniGroup is not liable for unsatisfactory services or any issues arising from unavailable, incorrect, or unsatisfactory products ordered from Merchants.
• Product images on the platform may not represent the actual items.

Personal Information

To use our service, you must create an account, which may require providing personally identifiable information such as your name, phone number, email address, and shipping address. You can choose to provide additional information as part of your profile, but we encourage you to be cautious with sensitive information.

Payment Information

For transactions, you will be required to provide payment information such as credit card or debit card details, which are processed by our secure third-party payment providers. MbuniGroup does not store your payment information. You are solely responsible for ensuring that your payment method has sufficient funds for transactions.

Delivery Information

• Estimated Delivery Time: Delivery times provided at checkout are estimates and may vary based on the Merchant’s processing time or unforeseen delays.
• Delivery Address: Orders are delivered to the address specified at the time of placing the order. Any changes to the delivery address may result in cancellation of the order at our discretion.
• Failure to Accept Delivery: If delivery cannot be completed due to incorrect or incomplete instructions from the Buyer, the goods are considered delivered, and no refund will be issued.

Prohibited Activities

The following activities are prohibited on the Platform:

• Using the Platform for illegal activities or violating any laws or regulations.
• Posting content that infringes on intellectual property or privacy rights, or that is defamatory, harassing, or offensive.
• Engaging in spamming, impersonation, or cyberbullying.
• Harvesting or collecting personal information without consent.

MbuniGroup reserves the right to:

• Investigate and remove content that violates these Terms of Use.
• Suspend or terminate access for users engaging in prohibited activities.
• Monitor and edit content on the Platform to ensure compliance with these Terms.

Amendments

MbuniGroup reserves the right to amend these Terms of Use at any time. Any changes will be posted on the Platform, and your continued use of the Platform after such amendments constitutes your acceptance of the updated Terms.

Payment and Refunds
